Who this is between
This agreement is between you and Fescue, a one-person operation
based in the United States. "We" and "us" mean Fescue. "You" means
you, whether you are a player posting scores or the commissioner
who set the league up.
Using Fescue means accepting this page. If you do not accept it,
do not use it — and tell your commissioner, because they will need
to fill your slot.
Our privacy policy covers what we hold and
who can see it. It is part of this agreement.
Your account
-
You need to be 18
League play in Fescue is built around a pot, and that makes it
an adult activity. You must be 18 or older to hold an account.
-
One account, yours
Sign in with your own email and keep your password to
yourself. Anything done from your account is treated as done
by you. Tell us straight away if you think someone else is in
it.
-
A name your league will recognise
Your display name is what the leaderboard shows the people you
play with. Use something they will know you by.
Commissioners and players
A league has one person running it, and most of what happens in
Fescue happens because they did it.
-
Your commissioner runs the league
They build the roster, set the schedule and the stakes, choose
how the league scores, name subs, mark absences and settle each
week. They can correct a card after the fact. That is their
call to make, not ours.
-
A wrong score goes through them
Scores and standings belong to the league, so we do not reach
into a league's records to change one. If a card is wrong,
your commissioner fixes it and re-settles the week.
-
A commissioner speaks for their league here
When a league takes out a subscription, the commissioner is
agreeing to this page on the league's behalf as well as their
own, and confirming they are allowed to.
We are not a party to your league's rules. Whether a sub counts,
what an absence costs, who is in for skins — your league decides
that, and Fescue records the answer.
The money in your league
Fescue counts money. It never moves any. Buy-ins,
skins, pins and weekly winnings are numbers in your league's
ledger so everyone can settle up honestly at the bar. No payment
between players runs through this app. There is nowhere in Fescue
to put a card number, and we never hold, escrow or transfer a
penny of your league's pot.
-
We take no cut
Not a rake, not a fee, not a share of a skin. The pot is the
players' money from the moment it is put in to the moment it
is paid out, and none of it passes through us.
-
Settling up is between you
If someone does not pay what the ledger says they owe, that is
a conversation for your league. We cannot collect it, enforce
it or arbitrate it, and the number on the screen is a record
of what your league agreed, not a debt owed to us.
-
Whether your game is lawful is yours to know
Rules about wagering between players differ by state and by
country, and a private game among people who know each other
is treated differently in different places. You and your
commissioner are responsible for knowing where you stand. Do
not use Fescue to run a pot where that is not allowed, and do
not use it to run a betting operation for people outside your
league.
-
The ledger can be wrong
It is arithmetic on what was entered. A mistyped score, a
missed absence or a stake changed mid-season all move the
numbers, and your commissioner can re-settle a week. Check the
card before you pay out on it.
Paying for Fescue
Billing is not switched on yet. Every league on Fescue today is
free, and no card is asked for anywhere in the app. This section
says how it will work when it starts, and no league will be
charged without an email first.
-
Two weeks free, per league
A new league gets its first two weeks on us. That is two real
league nights: you play, you close the weeks, you watch the
standings move. It is a trial of the thing itself, not a demo.
-
Then a subscription, once a year
After the trial a league is a paid annual subscription. One
price for the league, not per player — a player never pays
Fescue anything. Card payments are handled by Stripe, who take
the card details directly; we never see or store them.
-
It renews on its own, and you can stop it
The subscription renews automatically each year at the price
then posted, so a league does not go dark mid-season because
someone forgot a date. Cancel any time and it stops at the end
of the year you have paid for — you keep what you paid for and
are not charged again.
-
Refunds
Ask within 30 days of a charge and we will refund it in full.
After that we will look at it honestly rather than point at
this page.
-
A league that stops paying is not deleted
It goes read-only. You keep reading last season's standings,
every scorecard and the latest weekly recap for as long as we
run Fescue; what stops is posting new scores and closing new
weeks. Last season's
results are the thing a league most wants to argue about next
season, and we are not holding them hostage.
-
If the price changes
We will email the commissioner at least 30 days before a
renewal at a new price, so there is time to cancel instead.
What you write
Chat messages, your display name, anything you type into the app —
that is yours. You keep it. You give us permission to store it and
show it to your league, which is the only way a group chat can
work, and that permission ends when the content goes.
What you post is your responsibility. Keep it to things you would
say to the person's face in the car park:
-
Not allowed
Harassment, threats, slurs, someone else's private
information, or anything unlawful. Also: impersonating another
player, and posting scores for a round that was not played.
-
Who can remove it
Your commissioner runs your league and can deal with what is
said in it. We can remove content or an account over anything
in this section, and we will say why.
We do not read your league's chat to police it, and we do not
monitor it. We act when someone tells us.
The weekly recap
When your commissioner closes a week they can ask Fescue to write
the recap that goes with it. The prose comes back from a language
model, and a language model can get a detail wrong or land a joke
badly. Read it as the write-up, not the result.
The scorecard is the record. Standings, winnings
and the ledger are computed from the scores your league entered,
never from the recap. If the two disagree, the card is right.
What gets sent, and to whom, is in the
privacy policy. A league that would
rather this never happened can ask its commissioner not to
generate one.
Using it fairly
Short version: play golf, do not attack the database. Specifically,
do not
-
Reach into another league
Leagues are held apart by the database itself. Trying to get
around that, with the app or with the raw connection, ends the
account.
-
Scrape it, resell it, or rebuild it
No bulk extraction of other people's league data, no reselling
access, no copying Fescue to run a competing service. Your own
league's records are a different matter — ask and we will send
them to you.
-
Break it for everyone else
No load testing, no automated hammering, nothing that puts
league night at risk for someone else.
Finding a hole is not the same as exploiting one. If you find one,
tell us before you tell anyone else and we will not come after you
for looking.
What we promise
We promise to run Fescue carefully, to fix what breaks, and to
tell you when something has gone wrong rather than let you find
out on the tee.
What we do not promise is that it will never be down. Fescue runs
on other companies' infrastructure and is provided as it is, with
no warranty of any kind — not that it will be uninterrupted, not
that it will be error-free, and not that it fits any particular
purpose you have in mind. Features change, and some of them go
away.
Practical version: on a night when the app is down, your league
plays golf and writes the scores on paper, the way it did before.
Your commissioner can enter them afterwards.
If something goes wrong
We are liable for what the law says we are liable for, and this
page does not try to talk its way out of that. Nothing here limits
liability for fraud, for death or personal injury caused by
negligence, or for anything else that cannot be limited where you
live.
Beyond that: we are not liable for indirect or consequential loss,
for money your league did or did not settle between its players,
or for lost profits. Where liability can be capped, it is capped
at what your league paid us in the twelve months before the
problem, or 100 US dollars if that is more.
That cap is small because the price is small and we do not hold
your pot. If Fescue loses your scores, the honest remedy is that
we help your commissioner rebuild the week — which is why the
weeks can be replayed.
Ending it
-
You, any time
Delete your account in the app, from your profile or from the
screen you land on before you have joined a league. It is
immediate and it takes your sign-in with it. If you are the
only admin of a league, the app says so before it goes through,
because nobody will be left who can run it.
The one honest catch is in the
privacy policy: your completed
weeks stay in your league's record, under "Former member",
because deleting them would rewrite standings other people
played for.
-
Us, for cause
We can suspend or close an account that breaks this page.
Where it is not serious we will ask you to stop first.
-
Us, shutting down
If we ever stop running Fescue, we will give at least 90 days'
notice by email, refund the unused part of any subscription,
and make your league's records available to download before
the lights go off.
The law that applies
Michigan law governs this agreement, and the state and federal
courts in Michigan are where a dispute would be heard. If you are
a consumer somewhere that gives you the right to bring a claim
where you live, that right stands and this paragraph does not take
it away.
There is no arbitration clause here and no class-action waiver. If
we have a disagreement, email first — it has never not worked.
If a court finds one part of this page unenforceable, the rest of
it still stands.
Changes to this page
If the deal changes, this page changes with it and the date at the
top moves. Anything that meaningfully affects your league or costs
you money gets an email as well, not just a quiet edit — and for
anything to do with billing, at least 30 days before it takes
effect.
